They passed Senate Bill 494, which threw quite the curveball to the state’s cannabis scene by adding stricter regulations like testing, licensing, and age restrictions. The bill also banned hemp-infused food products, like brownies. Thankfully, Delta-9 gummies are still considered cool.

The Evolution of Delta-9 Laws in Georgia

Let’s rewind to where Georgia’s relationship with Delta-9 started getting interesting.

Back in 2019, the state dropped their Hemp Farming Act (House Bill 213), opening the door for hemp-derived products including Delta-9 THC – as long as they kept things at 0.3% THC or less by dry weight.

And just when everyone thought they had Georgia’s cannabis rules figured out, Senate Bill 494 entered the chat on October 1, 2024.

The bill tightened things up with new rules about safety, testing, and who can sell what, more specifically, it:

  • Prohibited the sale of hemp-derived products to people under 21. Just like alcohol, you’ve got to be over 21 to buy Delta-9 products in Georgia now. And that goes for both buying and having these products in your possession.
  • Put new bans on hemp-infused food products. While Delta-9 gummies and THC drinks are still legal, Georgia put a ban on hemp-infused baked goods. That means no more special brownies or cookies, but our gummies and non-alcoholic THC beverages are still 100% legal and ready to ship.
  • Banned alcoholic hemp beverages. Georgia’s made it crystal clear that they want you to keep your booze and your THC separate. The new law specifically bans any alcoholic beverages that contain hemp.

The new rules (specifically, Section 4, Line 182) require any THCa to be converted (or “decarboxylated”) when calculating total THC levels, using a specific formula to make sure everything stays legal.   • Updated licensing requirements. The state’s throwing a wider net with their licensing rules now. It’s not just growers anymore – manufacturers, retailers, wholesalers, and even testing labs need the right paperwork from the Georgia Department of Agriculture to stay legit.
  • Established new testing standards and labeling requirements. Georgia wants you to know exactly what you’re getting. Every hemp product needs a full panel certificate of analysis testing for all cannabinoids, plus warning labels approved by the Department of Agriculture. Types of Legal and Illegal Delta-9 Products

As long as they stick to the 0.3% Delta-9 THC limit, these products are totally legal in the Peach State:

With the super recent passing of Senate Bill 494, the state banned hemp-infused food products, and they got pretty specific about what counts as a “food product” in the fine print. Medical THC Oil Allowances in Georgia

Georgia opened the door for medical cannabis back in 2015 with the Haleigh’s Hope Act (House Bill 1). This law lets qualified patients use low-THC oil, but there’s a catch – it needs to come from a legit doctor and can’t pack more than 5% THC.

Don’t get too excited though. While the oil is fair game with proper paperwork, Georgia still says no to smoking, vaping, or eating your medicine. The state keeps a pretty specific list of who qualifies, including folks dealing with cancer, epilepsy, Parkinson’s disease, PTSD, and Crohn’s disease.

Can Your Employer Drug Test for Delta-9 in Georgia?
